On June 18th 2026, the current DOJ published a memo stating that the 1999 Olmstead Supreme Court decision did not uphold the Rehabilitation Act or Title II of the ADA, stating that states must provide the most community-integrated care possible to individuals with mental disabilities. This memo comes as a major multistate lawsuit, Texas V. Kennedy, has been filed against the Rehabilitation Act requirements and nationwide cuts to social services funding. These legal and policy actions leave disabled individuals without necessary care, force them into further poverty, and threaten to reinstate mass institutionalization.
